Nelligan O'Brien Payne's Condominium Law Practice Group handles issues of concern to condominium corporations, their directors, owners, and insurers. Our practice in this area is among the largest in Ontario. We provide legal services to over 500 condominium corporations in Eastern Ontario.

We are members of the Canadian Condominium Institute, and have had representatives on the Board at both the local and national level. We present regular courses on condominium law attended by condominium directors, managers and others, and publish Condo Law, a quarterly newsletter.

The Condominium Concept

On May 5, 2001, the new Condominium Act, S.O. 1998, c. 19 was proclaimed in force in Ontario. Members of the Nelligan O'Brien Payne condominium law practice group were directly involved in submissions regarding the new legislation, through committees and events involving interest groups and the provincial government. The new concepts include innovative applications for traditional condominium ownership, as well as vacant land ("bare land unit" condominiums), common element condominiums, and leasehold condominiums.

These concepts have been a long time coming. Our Condominium Law and Real Estate and Development practice groups embrace the application of the new forms of condominium ownership as solutions to title problems in existing projects involving common interests and in the creation of new and innovative structures tailored to specific shared property interests.

Our Condominium Law practice group is very involved in the creation of new condominiums and in the day-to-day operation of existing corporations, finding solutions for virtually every type of legal issue that may arise in structures of community living.

As a result of our involvement in condominium development and other forms of common ownership, we recently had the pleasure of hosting some 50 individuals involved in condominium development in eastern Ontario at a seminar on the New Condominium Act.
