IP Professionals, as well as trademark owners and applicants, should take note of the Canadian Intellectual Property Office’s pilot project regarding communications with the Trademarks Opposition Board.

In effect from September 1st 2016 to March 1st 2017, the project aims to expedite the communication of hearing correspondence and ensure timely communications with the Trademarks Opposition Board. The Board will provide parties with an email address where all correspondence sent to the Registrar of Trade-marks is to be forwarded to.

It is important to note that any email correspondences received will not be made of record in the underlying proceeding, and email related to substantive matters will remain prohibited for official correspondences with the Board.

The pilot project applies to parties scheduled for an upcoming hearing in an opposition or a section 45 proceeding.
